Subscription Agreement
Welcome to Capnix—a simple and fresh AI bucket hat try-on imaging tool, focusing on casual daily wear experience. This Subscription Agreement governs your subscription to the premium features of Capnix —referred to as the "Premium Subscription" or "Subscription"—provided by the App’s developer . By purchasing, subscribing to, or using the Premium Subscription, you acknowledge that you have read, understood, and fully agreed to be bound by all the terms and conditions of this Agreement, as well as our User Agreement and Privacy Policy. This Agreement is designed to be clear and straightforward, focusing on your rights and responsibilities as a Subscriber, the benefits of the Premium Subscription, and our unwavering commitment to protecting your privacy. If you do not agree to any part of this Agreement, our User Agreement, or our Privacy Policy, you must not purchase or use the Premium Subscription.
This Agreement applies to all Subscribers of the App’s Premium Subscription. By subscribing, you confirm that you are at least 18 years of age, have the capacity to agree to these terms, and have the authority to use the payment method associated with your Subscription. If you are under 18 years of age, you are strictly prohibited from purchasing or using the Premium Subscription, as we prioritize the privacy and safety of minors above all else. We do not design or intend the Premium Subscription for use by minors, and we ask that parents and guardians ensure minors do not access or use the Subscription or any of its features.
We offer three flexible Premium Subscription Plans to suit different Subscriber needs: Monthly Subscription, Six Month Subscription, and Yearly Subscription. Each Subscription Plan has a fixed duration: the Monthly Subscription is valid for 1 calendar month, the Six Month Subscription for 6 calendar months, and the Yearly Subscription for 12 calendar months. The specific pricing, duration, and full list of included Premium Features will be clearly displayed within the App (on the dedicated subscription page) before you complete your purchase. All pricing is shown in the currency specified on the subscription page, and we reserve the right to adjust pricing from time to time. Any price adjustments will not affect existing Subscribers during their current Subscription period; new pricing will only apply to new Subscriptions or renewals after the current period expires.
The Premium Features included with your Subscription are designed to enhance your Capnix experience, complementing the App’s free core features, and include (but are not limited to):
We reserve the right to modify, add, or remove Premium Features at any time, provided that such changes do not materially reduce the overall value of the Subscription during your current Subscription period. We will notify you of any significant changes to Premium Features through the App (via a clear, unobtrusive notification) to ensure you are always informed about the benefits of your Subscription.
To purchase a Premium Subscription, you must select your preferred Subscription Plan and provide a valid payment method (e.g., credit card, debit card, or other payment methods supported by the App or your device’s app store). By providing your payment information, you authorize us (or our authorized third-party payment processor) to charge the applicable subscription fee to your selected payment method. All subscription fees are non-refundable except as explicitly provided in Section 5 of this Agreement.
Payment will be processed immediately upon your purchase of the Subscription. The subscription fee covers access to all Premium Features for the entire duration of your selected Subscription Plan. You are responsible for any applicable taxes, fees, or charges associated with your Subscription, which may be added to the subscription fee and charged to your payment method. We will clearly display any applicable taxes or additional fees on the subscription page before you complete your purchase, so you can review the total cost upfront.
You agree to provide accurate, current, and complete payment information, and to update your payment information promptly if it changes (e.g., expired credit card, changed billing address, or new payment method). Failure to provide accurate payment information may result in payment failure, suspension of your Premium Subscription, or termination of this Agreement. If your payment is declined, we will notify you through the App, and you will have 7 days to update your payment information and complete the payment; otherwise, your Subscription request will be canceled, and you will not have access to the Premium Features.
Unless you turn off auto-renewal before the end of your current Subscription period, your Premium Subscription will automatically renew for the same duration as your current Subscription Plan (e.g., a Monthly Subscription will renew for another month, a Yearly Subscription will renew for another year). The applicable subscription fee for the renewal period will be charged to your selected payment method on the renewal date. We will send you a reminder notification through the App at least 3 days before the renewal date, so you have sufficient time to decide whether to continue the Subscription or turn off auto-renewal.
You can turn off auto-renewal at any time, free of charge, through the App’s settings (under the "Subscription" tab) or your device’s subscription management page (e.g., Apple App Store, Google Play Store). Turning off auto-renewal will not cancel your current Subscription; it will only prevent the Subscription from renewing automatically at the end of the current period. You will continue to have full access to all Premium Features until the end of your current Subscription period, and no further charges will be made after the period expires.
If the auto-renewal payment fails (e.g., insufficient funds, expired payment method, declined transaction, or billing address mismatch), we will attempt to process the payment again within a reasonable period (up to 3 times over 7 days). If the payment still fails after multiple attempts, your Premium Subscription will be suspended until the payment is successfully completed. During the suspension period, you will not have access to the Premium Features, but you will still be able to use the App’s free core features. If the payment is not completed within 7 days of the renewal date, your Subscription will be terminated, and you will lose access to the Premium Features. You may re-subscribe at any time after termination, but you will be subject to the current pricing and terms of the Subscription Plans at the time of re-subscription.
Your privacy remains our top priority, even when you subscribe to the Premium Subscription. We adhere strictly to the privacy practices outlined in our Privacy Policy, and your Subscription does not result in any additional data collection beyond what is described in our Privacy Policy. Our core privacy commitments for Subscribers are as follows:
We understand that your trust in our privacy practices is essential, and we go to extraordinary lengths to ensure that your privacy is protected at every step of your experience with the Premium Subscription. Your Subscription is designed to enhance your creative experience, not to compromise your privacy—you can enjoy all the benefits of the Premium Features while knowing that your personal information and images are safe and secure.
You may cancel your Premium Subscription at any time. To cancel, you can turn off auto-renewal through the App’s settings or your device’s subscription management page (as outlined in Section 3). Turning off auto-renewal will ensure that your Subscription does not auto-renew after the current period expires. If you cancel auto-renewal, you will still have full access to the Premium Features until the end of your current Subscription period, and no further charges will be made after the period expires.
Subscription fees are non-refundable, except in the following limited circumstances:
To request a refund, you must contact us at doandung1966tn@gmail.com, provide your Subscription details (e.g., the date of purchase, the Subscription Plan, and the payment method used), and a detailed explanation of why you are requesting a refund. We will review your refund request within 5 business days and notify you of our decision via email. Refunds will be processed to the same payment method used for the original purchase, and the processing time may vary depending on your payment provider (typically 3-7 business days).

During your Subscription period, you are entitled to the following rights, subject to your compliance with this Agreement, our User Agreement, and our Privacy Policy:
Your right to use the Premium Subscription is limited to your personal, non-commercial use. You may not share your Subscription access, Premium Features, or any content provided through the Premium Subscription with any third party (including but not limited to family members, friends, or colleagues). This includes sharing your device with others to access the Premium Features, or using the Subscription to generate try-on photos for commercial purposes without our prior written consent. Sharing your Subscription access or using it for commercial purposes is a violation of this Agreement and may result in termination of your Subscription without refund.
When using the Premium Subscription, you must comply with the following obligations, in addition to the obligations set out in our User Agreement:
You are solely responsible for all activities conducted through your Subscription when using the Premium Features, including any content you upload, generate, or share, and any consequences arising from your non-compliance with this Agreement. You agree to bear all losses, liabilities, and costs incurred by us or any third party due to your violation of this Agreement or improper use of the Premium Subscription. This includes but is not limited to losses caused by sharing your Subscription access, using the service for commercial purposes, uploading inappropriate content, or infringing on the rights of others.
All intellectual property rights related to the App and the Premium Subscription—including but not limited to the AI algorithms, built-in bucket hat templates (especially premium exclusive styles), software, code, design, text, graphics, and any other content provided through the Premium Features—are owned exclusively by us or our authorized licensors. This Agreement does not transfer any intellectual property rights from us to you; you only receive a limited, non-exclusive, non-transferable right to use the App and the Premium Features for personal, non-commercial purposes.
With respect to the try-on photos you generate using the Premium Features: You retain full ownership rights to the try-on photos you create for personal, non-commercial use. You may save, share, or use these photos as you wish, provided that you do not violate this Agreement or the rights of others. However, you may not use the try-on photos for commercial purposes (such as selling, promoting, or monetizing them) without our prior written consent. If you wish to use the try-on photos for commercial purposes, you must contact us at doandung1966tn@gmail.com to request permission and discuss any applicable terms.
You agree not to infringe on our intellectual property rights or the intellectual property rights of any third party when using the Premium Subscription. This includes but not limited to copying, modifying, distributing, or using the App’s premium bucket hat templates, software, or other content without our permission. We reserve the right to take action to protect our intellectual property rights, including restricting access to the App and the Premium Subscription for users who violate this provision.
We may occasionally update the App to improve its functionality, add new bucket hat styles (including premium exclusive styles), fix bugs, enhance privacy protections, or improve the AI try-on algorithm. These updates may include new features, changes to existing features, or improvements to the Premium Subscription experience. We will notify you of major updates through the App (via a clear, unobtrusive notification) the next time you open it. You agree to download and install all necessary updates to ensure the App and the Premium Features work properly and to maintain the highest level of privacy protection.
We may also modify this Agreement from time to time to reflect updates to the App, the Premium Subscription, or our privacy practices. However, any modifications will never reduce your privacy protections—we will never start collecting personal information, facial data, or any other sensitive information, and we will never change our practices to allow for data sharing or tracking. Your continued use of the Premium Subscription after any modifications to this Agreement means that you agree to the revised terms. We encourage you to review this Agreement periodically to stay informed about your rights and responsibilities as a Subscriber.
Your Premium Subscription will automatically terminate at the end of your Subscription period if you turn off auto-renewal or if the auto-renewal payment fails and is not resolved within 7 days. You may also terminate your Subscription by canceling auto-renewal, as set out in Section 5.
We may terminate or suspend your access to the Premium Subscription (and the App, if necessary) at any time, without prior notice, if we determine that you have violated this Agreement, our User Agreement, or our Privacy Policy. This includes but not limited to:
Upon termination of your Premium Subscription, you will lose access to all Premium Features immediately (if terminated for violation) or at the end of the current Subscription period (if canceled or expired). You will still be able to use the App’s free core features, unless your access to the entire App is terminated due to a serious violation of the User Agreement.
Upon termination, all rights and obligations you have under this Agreement will cease, except for any rights or obligations that should survive termination (including but not limited to intellectual property rights, privacy protection obligations, and liability for past violations). We will not be liable to you for any loss or inconvenience caused by the termination of your Premium Subscription, especially if the termination is due to a violation of this Agreement. If the Premium Subscription is terminated due to your violation of this Agreement, you will not be entitled to any refund of the subscription fee.

Importantly, we will never ask for any personal information to assist you—you can communicate with us completely anonymously, without sharing your name, email address, or any other identifying details. We respect your privacy even when you reach out for support.
We value your feedback and use it to improve the App and the Premium Subscription experience. Whether you have a question about how we protect your privacy, need help with a Premium Feature, want to request a refund, or suggest a new bucket hat style, we are here to listen and assist. Our goal is to ensure that you have the best possible experience with Capnix’s Premium Subscription, while keeping your privacy and safety our top priorities.
This Agreement takes effect on the date you purchase or subscribe to the Premium Subscription. We reserve the right to interpret this Agreement in a way that is fair and consistent with our commitment to protecting your privacy and providing a positive Subscription experience. If any part of this Agreement is found to be unenforceable, the remaining parts will remain in full effect.
